Terms of Service

These terms govern your use of the Penny app and its services. By using Penny you agree to them. If you don't agree, please don't use Penny.
1. The service
Features may change, be interrupted, or be removed as Penny evolves, and — despite the export and sync safeguards we build — you should not treat Penny as your only copy of anything irreplaceable. We may suspend or end the service at any time.
2. Your account
A Penny account (email address) is required to use the app. You are responsible for keeping your credentials safe and for what happens under your account. You must be at least 13 years old (or the minimum age in your country) to use Penny.
3. Your content
Your memories are yours. You keep all rights to everything you capture in Penny. You grant Penny only the limited license needed to operate the service for you — storing, transcribing, categorizing, searching, and resurfacing your content. We never use your memories to train AI models, and we never sell or share them, as described in the Privacy Policy. You can export your data at any time from Settings → Export All Data, or permanently delete it from Settings → Delete Account & All Data.
4. Acceptable use
Don't use Penny to break the law, to harm others, to probe or disrupt the service, or to attempt to access another person's data. We may suspend accounts that do.
5. Subscriptions
Every new Penny account includes a 14-day free period with full access and no payment method required. After day 14, a Penny Pro subscription is required to keep using Penny: the app shows the plans and won't let you continue until you subscribe or restore a purchase. Nothing is deleted when the free period ends — your notes stay in your account and are there again as soon as you subscribe. From that screen you can also export your data, sign out, or permanently delete your account.
Penny Pro is offered as two auto-renewing subscription plans — Penny Pro Weekly (1 week) and Penny Pro Annual (1 year) — billed through your Apple Account. Prices are shown in the app and on the App Store before you buy, and you can view the plans in Settings from day one.
Payment is charged to your Apple Account at confirmation of purchase. Each plan then renews automatically for another period of the same length unless you cancel at least 24 hours before the end of the current period — manage or cancel anytime in your Apple Account settings (Settings > [your name] > Subscriptions on your device). If a renewal payment fails, you keep access while the App Store retries it. If we change subscription pricing, we'll notify you in advance as required by App Store policy before any new price applies to you. Penny never stores your payment details.

6. Commerce shortcuts
Retailer shortcuts are not enabled in the current release. If they ship, Penny may show optional shortcuts for things you noted you want to buy; some may use affiliate links, which may earn Penny a commission at no extra cost to you. They will be disableable in Settings. Purchases are made with the retailer, not Penny.
7. Disclaimers
Penny is provided "as is," without warranties of any kind. AI-derived organization, transcription, and suggestions can be wrong — verify anything important. To the maximum extent permitted by law, Penny's liability for any claim arising out of your use of the service is limited to the amount you paid for the service in the 12 months before the claim arose (zero, if you never subscribed).
8. Ending things
You can stop using Penny and delete your data at any time from Settings → Delete Account & All Data. We may suspend or close accounts that violate these terms. Sections 3, 7, and 9 survive termination.
9. Changes & contact
We may update these terms as Penny grows; material changes will be announced in the app, and continued use after a change means you accept it. Questions: penny@penny-thoughts.com.
